Adidas sues Nike for infringing 9 of its patents

2022-06-15

Adidas and Nike clash again. It marks Adidas' first federal lawsuit against its rival in a long-running battle between the world's two biggest sneaker brands.

The lawsuit, filed on June 10, claims Nike has infringed nine Adidas patents. Point out that the Nike SNKRS app, Running Club, Training Club, etc. infringe Adidas' intellectual property rights.

In addition, Adidas claimed that its 2005 "Adidas_1" sneaker was also infringed, calling it "the world's first smart running shoe that senses and adjusts shoe comfort while wearing."

As a result of the lawsuit (filed in eastern Texas), Adidas seeks financial damages "sufficient to compensate Adidas defendants for infringement of the sued patent, but not less than reasonable royalties, plus interest and costs."

By contrast, the news comes after Nike filed a lawsuit against Adidas last year, which the brand filed claims that Adidas' "Primeknit" technology infringed its patented "Flyknit" technology.

Additionally, the Nike SNKRS app is said to have the same functionality as the adidas Confirmed app, which was released in February 2015 and the former in May.

"Adidas has long been a leader in mobile technology, including in fitness and online ordering," the company's lawsuit states.

The exact amount of compensation that Adidas is demanding from Nike is unknown.

Nike and Adidas are the two largest footwear companies in the world, with assets of $182 billion and $36 billion, respectively.

Although new players have entered the market in recent years, a handful of heavyweights still dominate. Nike and Adidas have not only been able to maintain their positions, but have grown exponentially over the past 10 years. Competition between brands is the driving force for both companies.

Although it appears that these companies have the same business model, there are significant differences between the two.
