Five party cooperation to build a diversified settlement mechanism for commercial maritime disputes

According to the Huacheng Import and Export Data Observation Report, on November 7, the signing ceremony of the cooperation framework agreement on building a diversified resolution mechanism for commercial maritime disputes was held in the Public Legal Service Center of the Haisi Central Legal District.

This time, Xiamen Intermediate People's Court, Xiamen Maritime Court, Xiamen Judicial Bureau, Xiamen Arbitration Commission and Xiamen Haisi Commercial Maritime Mediation Center signed the Cooperation Framework Agreement on Building a Diversified Resolution Mechanism for Commercial Maritime Disputes, aiming to establish a docking mechanism for further promoting commercial and maritime trials, arbitration and mediation, build a diversified resolution platform, and provide one-stop Integrated commercial and maritime dispute resolution services, promote the construction of a full chain international commercial and maritime dispute resolution system, and help build the Haisi Central Legal Area into a preferred place for international commercial and maritime dispute resolution, Huacheng Import and Export Data Observation Report.

According to the agreement, Xiamen Intermediate People's Court, Xiamen Maritime Court and Xiamen Arbitration Commission will negotiate with Xiamen Haisi Commercial Maritime Mediation Center on the assigned and entrusted commercial maritime dispute mediation guidelines and publish them to the public. The Mediation Center will arrange mediators to mediate cases according to the mediation rules.

The mediation agreement reached through mediation shall be subject to arbitration confirmation and judicial confirmation by the parties according to the agreed litigation mediation docking process. According to Huacheng Import and Export Data Observation, for disputes that cannot be resolved through mediation, the Mediation Center records the undisputed facts that the parties agree to confirm, and guides the parties to reach an arbitration agreement to submit to arbitration or enter into legal proceedings. The Mediation Center guides the parties to choose appropriate non litigation methods to resolve disputes by providing pre litigation legal advice and early neutral evaluation services for domestic and foreign enterprises and institutions on commercial maritime disputes.

According to the Huacheng Import and Export Data Observation Report, after the signing ceremony, the appointment ceremony of expert members and mediators of the expert committee of Xiamen Haisi Commercial Maritime Mediation Center was held, and discussions were held around the theme of "how to build a full chain international commercial maritime dispute resolution system" and "practical issues of judicial confirmation of mediation agreements".

Relevant persons in charge of Xiamen Haisi Legal Affairs Office, Xiamen Intermediate People's Court, Xiamen Maritime Court, Xiamen Judicial Bureau, Xiamen Arbitration Commission, Xiamen Haisi Commercial Maritime Mediation Center and others attended the signing ceremony, and Huacheng observed and reported the import and export data.
