Brazil and Vietnam's anti-dumping rulings on polyester textiles from China and India

On September 30, 2021, the Brazilian Foreign Trade Secretariat issued Announcement No. 64 of 2021 in the Federal Government Gazette, stating that for non-retail polyester fiber yarns (except sewing threads) originating in China and India, including A preliminary anti-dumping ruling was made for synthetic fiber monofilaments with a fineness of less than 67 dtex, and it was preliminarily ruled that the products involved in the case were dumped in the above-mentioned countries and that the dumping caused damage to the domestic industry in Brazil, but temporary measures were not taken for the time being. The Mercosur tax codes of the products involved are 5402.33.10, 5402.33.20, and 5402.33.90.

On March 5, 2021, the Brazilian Foreign Trade Secretariat issued the Announcement No. 18 of 2021 in the Federal Government Gazette, stating that, at the request of the Brazilian Association of Man-made and Synthetic Fiber Products (Abrafas), non-supply of non-supply originating in China and India Retail polyester fiber yarn (except sewing thread), including synthetic fiber monofilament with a fineness of 67 dtex or less, initiates an anti-dumping investigation.

On October 13, 2021, the Ministry of Industry and Trade of Vietnam issued Resolution No. 2302/QD-BCT, which made a definitive anti-dumping ruling on polyester filament yarns imported from China, India, Indonesia and Malaysia, and ruled that the above-mentioned countries should be formally dealt with. Anti-dumping duties are levied on the products involved in the case, of which the tax rate of the products involved in China is 3.36-17.45% (see the attached table for details), 54.90% in India, 21.94% in Indonesia, and 21.45% in Malaysia. This case involves products under Vietnamese tax codes 5402.33.00, 5402.46.00 and 5400.47.00. The measures will take effect on the 3rd day of the announcement.

On April 6, 2020, Vietnam initiated an anti-dumping investigation on polyester filament yarns imported from China, India, Indonesia and Malaysia. On September 1, 2021, the Ministry of Industry and Trade of Vietnam issued Resolution No. 2080/QD-BCT, making a positive preliminary anti-dumping ruling on the case, and initially ruling to impose provisional anti-dumping duties on the products involved in the case, of which the tax rate of the products involved in the case in China is 3.36 17.45%, India 54.90%, Indonesia 21.94%, Malaysia 21.23%.
